Reviewed July 2026 · Adopted August 2026

1. Policy Statement

GCC Board Zero-tolerance
  1. The purpose of this policy is to establish a framework for protecting children, adults at risk, beneficiaries, staff, volunteers, and community members from harm, ensuring a safe and respectful environment across all organizational activities and operations when working for, on behalf of, or in partnership with GCC.
  2. GCC adopts a zero-tolerance approach towards all forms of abuse, exploitation, neglect, harassment, discrimination, retaliation, and any safeguarding breach. Every allegation shall be treated seriously, investigated fairly, and addressed promptly, irrespective of the status, seniority, or relationship of the alleged perpetrator to the Organization.
  3. This encompasses assisting GCC to develop a mutual understanding of safeguarding issues and best practice across the diverse and complex areas in which we operate, thereby increasing accountability in this crucial aspect of our work.
  4. Every Board member, employee, volunteer, consultant, intern, contractor, partner, donor representative, researcher, visitor and any other individual acting on behalf of GCC shall receive this Policy prior to engagement and shall sign a Safeguarding Declaration confirming that they have read, understood and undertake to comply with its provisions.
  5. Any breach of this Policy shall constitute misconduct and may result in disciplinary action up to and including dismissal, termination of contracts, withdrawal of volunteer status, referral to professional regulatory bodies, reporting to statutory authorities and/or criminal prosecution where applicable.
  6. This Policy shall be reviewed at least once every two years or earlier where there are legislative changes, significant safeguarding incidents, organizational restructuring or recommendations arising from safeguarding audits.
Clause 1

2. Definition of Key Terms

Terminology Clarity

This list contains the working definitions of terms essential to the effective implementation of this policy. However, GCC is alive to the fact that this is not a comprehensive list and as such shall be updated as the need arises. These key terms include the following:

  1. Safeguarding: The responsibility that an organization has to ensure that their employees and volunteers, partners, vendors, operations and programmes do no harm to individuals; do not expose them to the risk of discrimination, neglect, harm, exploitation and abuse; and that any concerns the organization has about the safety of individuals within the communities in which they work, are dealt with and reported to the appropriate authorities. It is also the responsibility of the organization to protect its employees and volunteers when they are vulnerable, for example, when ill or at risk of harm or abuse.
  2. Vulnerable Adults/ Adults at Risk: In the context of this policy, a vulnerable adult (also referred to as an adult at risk) is any person aged 18 or over who, due to age, disability, mental or physical health conditions, economic capacity, displacement, or other circumstances, may be unable to protect themselves from abuse, neglect, or exploitation. Some of the individuals engaged by/with GCC live in low-income settings and may experience intersecting vulnerabilities. This includes, but is not limited to persons with disabilities, mental or physical health challenges, individuals facing economic hardship and adults who are socially excluded or lack support networks. GCC recognizes that vulnerability is not always visible or permanent. Anyone may be at risk depending on their situation, and as such, our safeguarding practices will be inclusive, respectful, and responsive to all community members, with special attention to those most at risk.
  3. Best Interest of the Child: All decisions affecting children shall prioritize the child's best interests in accordance with Article 53(2) of the Constitution of Kenya and the Children Act, 2022.
  4. Child Abuse: This includes physical abuse, emotional abuse, sexual abuse and neglect.
Clause 2

3. Relevant Laws and Legislation

Legal framework International & national
  1. At the international level: Article 19 of the United Nations Convention on the Rights of the Child requires that:
    1. States Parties shall take all appropriate legislative, administrative, social and educational measures to protect the child from all forms of physical or mental violence, injury or abuse, neglect or negligent treatment, maltreatment or exploitation, including sexual abuse, while in the care of parent(s), legal guardian(s) or any other person who has the care of the child.
    2. Such protective measures should, as appropriate, include effective procedures for the establishment of social programmes to provide necessary support for the child and for those who have the care of the child, as well as for other forms of prevention and for identification, reporting, referral, investigation, treatment and follow-up of instances of child maltreatment described heretofore, and, as appropriate, for judicial involvement.
  2. At the regional level: African Charter on the Rights and Welfare of the Child which provides for:
    1. Protection against harmful traditional practices, such as early marriage and female genital mutilation (Article 21).
    2. Protection from sexual exploitation (Article 27).
    3. Protection against drug abuse (Article 28).
  3. At the national level: The Constitution of Kenya 2010, which provides for:
    1. Protection of children from abuse, neglect, harmful cultural practices, all forms of violence, inhuman treatment and punishment, and hazardous or exploitative labor (Article 53).
    2. Other relevant legislation includes:
      1. The Children Act of 2022 which serves as a foundational umbrella policy instrument on child protection and child welfare services.
      2. The Sexual Offences Act of 2006 which makes provision to protect children at risk of sexual abuse, from being subjected to sexual abuse or having to witness sexual acts. It also prescribes stiffer penalties for sexual offenders especially for the offence of defilement depending on the complainant's age.
      3. The HIV/AIDS Prevention and Control Act of 2006 which provides that no educational institution shall deny admission or expel, discipline, segregate, deny participation in any event or activity, or deny any benefits or services to a person/child on the grounds only of the person's actual, perceived or suspected HIV status.
      4. The Employment Act of 2007 which declares and defines the fundamental rights of employees, provides for basic conditions of employment of children, and to provide for matters connected with the foregoing.
      5. The Counter Trafficking in Persons Act of 2010 which criminalizes acts that promote child trafficking including adopting, fostering or guardianship or offering a child for adoption, fostering or guardianship for purposes of trafficking.
      6. The Penal Code which protects children from acts and omissions, which amount to child abuse, including assault, abduction, kidnapping, abortion, etc and prescribe a penalty against any person found guilty of such offences.
      7. Others include: the National Children Policy (2010); the National Policy for Prevention and Response to Gender Based Violence (2014); the National Plan of Action for Children in Kenya (2015-2022); and the National Policy for the Eradication of Female Genital Mutilation (2019), among others.

If necessary, move to a place where you can both be seen by other colleagues or other adults. This prohibition extends to online communication, electronic messaging, social media interactions and any conduct intended to groom or exploit a child.

Employees of GCC must not:

  1. Engage in any form of physical, emotional, psychological or sexual abuse, exploitation, neglect, bullying, intimidation, harassment or discrimination against any child, adult at risk or beneficiary.
  2. Initiate, encourage, or fail to act upon inappropriate, exploitative, or sexual relationships with any individual that is in a position of vulnerability or dependency. 3. Use inappropriate language, gestures, jokes, physical contact, digital communication or behaviour that may humiliate, shame, intimidate, exploit or place another person at risk. Employees shall explain from the outset that confidentiality cannot be guaranteed where disclosure indicates that an individual is at risk of harm.
  4. Give, display or distribute pornographic, sexually explicit, violent or otherwise inappropriate materials to children or adults at risk. Delay, conceal or intentionally fail to report safeguarding concerns.
